TOTALROCK UNSIGNED BAND AWARDS ENTRY RULES AND REQUIREMENTS
Below we’ve set out everything you need to know about the TotalRock Unsigned Band Awards (“the Awards”) including how to enter. This information is important so please take some time to read through it carefully. It includes:
· Important information about your use of www.totalrock.com and everything you need to know about registering on the Website including what we’d like you to send us (and what we’d prefer not to see).

Naturally we want to assure everyone that the competition and its terms and conditions are all in good faith and that we seek no undue rights as artists from you. Your use of www.totalrock.com
By registering on www.totalrock.com (the “Website”) you agree to be bound by and comply with these terms and conditions (which includes our Privacy Policy). They're basic good common sense to make sure we avoid offending anyone or breaking the law. To register to use the Website you must be over 16.
You are entirely responsible for what you submit to the Website, including any interaction with or information you transmit to other users. You agree that (1) the posting of any material on the Website will not infringe the rights of others; (2) you own the copyright for the material you post and have the full right to submit such material; (3) you have the express consent of anyone appearing in material that you submit to that material’s submission, and to the posting of that material to the Website.
Please don’t…
· Upload content that is, or contains material which is, defamatory, libellous or slanderous, or which might embarrass someone or invade their privacy, is vulgar, tasteless or obscene, racist, abusive, malicious or derogatory (toward an individual or business entity) or which uses gratuitous coarse language.
· Send material that is copyrighted without the permission of the owner. Images (including artwork and photographs) that predominantly depict a trademark or logo, with little or nothing else, or are of celebrities or public figures, are not permitted.
Remember!
We may (but are not obliged to) review material uploaded onto the Website for suitability and compliance with these terms before it is posted. Submitting material does not guarantee that it will be published on the Website and we may reject or accept your material for any reason in our absolute discretion. Further, we may at any time and without notice or further liability to you: (1) take down your material; and (2) restrict or terminate your access to the Website.
We will not, be liable, whether through negligence or breach of contract or otherwise, for any loss or damage (whether direct, indirect or consequential and including loss of revenue or profit) which you suffer or incur in connection with your use of the Website. Your profile may be modified or deleted and your use of the Website may be terminated without warning, at our discretion.
Your privacy
Unless you tell us during the registration process that you want to receive further information from us, information we obtain about your use of the Website will only be used to provide and manage the Website service.
If required, and/or where necessary, we may disclose information about your use of the Website to law enforcement agencies, and/or other authorities, for the investigation, prevention and detection of crime and the apprehension and prosecution of offenders.
How to enter and vote in the awards
1. Taking part
To take part in the awards you must be over 16. By submitting your audio track and your image (together the “Material”) to the TotalRock Unsigned Band Awards (the “Awards”) you agree you are bound by and will comply with these terms and conditions (which include TotalRock’s Privacy Policy) [www.totalrock.com/privacy.htm].
1. You will be submitting the Material to TotalRock Music Limited (“TotalRock”). Accordingly you are granting rights to TotalRock to distribute and exploit the Material as set out in this information. TotalRock may sub-licence these rights to a third party in order to manage the competition.
2. You are responsible for the Material you submit to the Awards.
3. There must be nothing contained in the Material which is defamatory, libellous or slanderous, or which might embarrass someone or invade their privacy, is vulgar, tasteless or obscene, racist, abusive, malicious, or derogatory (towards an individual or business entity).
4. The Material must not contain an abundance of gratuitous coarse language.
5. You will not submit the Material if it includes copyright work (such as existing music, lyrics etc) which is owned by a third party, without their consent. Unauthorised remixes, sampling or cover versions are NOT permitted. If you do not have the permission of the copyright owner(s) to use their material then your Track is unauthorised and most likely in breach of copyright. We reserve the right to remove any Tracks which infringe or are likely to infringe third party copyright and take any further action as we deem necessary.
6. By submitting your Material you warrant that: (1) the submission of the Material and subsequent use of the Material by us will not infringe the rights (including intellectual property rights) of others; (2) you (or your band jointly) own the copyright in the Material you submit and have the full rights to consents necessary to submit such Material to the Awards.
7. You must not submit any image which is offensive or which shows celebrities or public figures or which infringes on an individual’s right to respect for their private life.
8. Your Material will be reviewed for suitability and compliance before it is made available for viewing.
9. All acts must be unsigned and retain full rights over their submitted Material. We reserve the right to disqualify any act that is signed to a recording or publishing deal before the end of the competition on 30 June 2007.
10. The entry fee of ten Great British pounds (£10) (“the Entry Fee”) must be paid before your entry can be submitted. Payment of the Entry Fee can be made through PayPal (using paypal@totalrock.com). Other methods of payment of the Entry Fee can be arranged by emailing the Awards support email link on the Website. On completion of payment each entry will be credited with ten (10) votes (equivalent value two Great British pounds (£2)). Entrants will also receive a certificate confirming their nomination in the entered Category.
2. How to send us your track
1. For entries to be considered valid all required fields on the registration web-form must be completed and must include an artist/group photo as a GIF or JPG file with a maximum size of 150 x 150 pixels. The submitted track must be uploaded in MP3 format with a maximum file size of 6Mb. Incomplete entries may be rejected.
2. Physical entry submissions will be accepted provided that they are include all the information required by the online registration process and payment of the Entry fee by cheque or money order. Please see online registration fields for required data. Physical entries must contain one (1) image of the band as a GIF or JPG file with a maximum size of 150 x 150 pixels and one (1) audio track in MP3 format with a maximum file size of 6Mb and must be sent on CD to:

No formats other than Data CD will be accepted. Please label your CD appropriately (artist/group name and contact details) and make sure it is securely packaged. We cannot accept responsibility for lost or damaged entries, nor can we return any media (CDs, photos) sent to us under any circumstances. DO NOT send us a master copy!
3. Using your entry
By entering the competition and submitting your Material you acknowledge and agree that you are granting a royalty free licence to TotalRock to utilise and exploit the Material as set out in the competition information. We may in our sole discretion and without notice to you:
(a) determine the look and feel, aggregation, layout and placement of the Material on www.totalrock.com;
(b) reasonably edit, alter, adapt, reformat, tag or otherwise modify your Material.
4. Ownership of Materials submitted
In consideration of giving you the ability to take part in the competition:
We shall have the unrestricted right to exploit the Material submitted in any media throughout the world in any manner we wish.
You hereby waive unconditionally and irrevocably all moral rights in relation to the Material and agree not to assert any moral rights against TotalRock or its affiliates or agents involved in this competition worldwide.
You agree that no further consideration shall be due to you in respect of the exploitation of the Material.
You agree to do any and all acts and execute any and all documents as may be required by us in order to protect perfect or enforce any of the rights granted.
5. Other information
In all stages of the Awards, the judges’ decision is final and no correspondence will be entered into.
Details of the shortlisted and winning acts and the judges’ names will be published on www.totalrock.com.
We reserve the right to vary the Awards and Entry Rules and Requirements from time to time as necessary. If this happens we will publish details of the changes on the Website.
These TotalRock Unsigned Band Awards terms are governed by English law.
